After meeting regularly and negotiating for over a year, this was the first time since 1997 that a new collaborative, voluntary standard form of surface lease was developed for use in private land lease negotiations in British Columbia. Key issues which kept emerging were the nature and timing of legal surveying, types of legal survey plans registerable in the BC Land Titles Office, allowable lease and statutory right-of-way characteristics (leases cannot overlap, whereas statutory right of ways can) and finally, processes for removing a lease and/or a statutory right of way charge from title when they are no longer required.
